The Website is operated by Us, American Overseas Memorial Day Association Foundation ASBL (a company incorporated under the laws of Belgium, having its registered office at 1200 Sint-Lambrechts-Woluwe, Almaplein 3 mailbox 7, registered under the number 0403.086.468, and Personal Data collected through it will be controlled by Us.

By accessing, browsing or downloading any part of the Website or of its content (hereinafter referred to as the “Content”), or by posting or uploading to the Website, or by using the services provided through the Website (hereinafter referred to as the “Services”) or by any other use of the Website and of its Content, whether as a registered user or an unregistered user, the visitor (hereinafter referred to as “You”) declares that he has read and accepted the Privacy Policy.

If You are under the age of majority in Your state (i.e., if You are a minor) You represent to Us that, You have the required consent to do so from a parent or legal guardian, and that Your parent or legal guardian has read and agreed to this Privacy Policy. Please be advised that We use the PayPal service and that the relevant privacy policy is available here and applies to any information You submit during payment process through the Website. We will receive Your name, address, e-mail address, phone number and donation amount from PayPal for the purpose of processing your donation and issuance of a receipt.

9.Protection of Personal Data by Us

We comply with the Belgian Act of 8 December 1992 on the Protection of Privacy in relation to the processing of personal data, the processing of data was notified to the Belgian Commission for the Protection of Privacy. We take reasonable efforts such as implementing security measures as We deem appropriate and consistent with industry standards (such as firewalls and encryption technology) to secure and protect the privacy, accuracy and reliability of the Personal Data provided by You and to avoid loss, misuse, unauthorized access, disclosure, alteration and destruction of the same. All Personal Data We collect about You is used in compliance with the purpose for which it was collected or authorized by You, i.a. under the Privacy Policy and the applicable Terms and Conditions.

Our activities are international by nature. We highlight that We are affiliated to AOMDA Foundation, a non-profit organization, with registered office in Washington DC, (1090 Vermont Avenue, N.W., Washington D.C. 20005, USA), and registered in Washington DC as a 501c3 charitable organization (hereinafter referred to as “AOMDA USA”) who is responsible for the processing of personal data it receives from Us and You accept that Personal Data We collect about You may be transferred to AOMDA USA.

We certify that for all onward transfers AOMDA USA complies with the EU-U.S. Privacy Shield Framework and is committed to subjecting all Personal Data received from European Union Member States in compliance with the principles applicable under the said Framework including the onward transfer liability provisions. With respect to Personal Data received or transferred pursuant to the Privacy Shield Framework, AOMDA USA is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission and may, in certain situations, be required to disclose personal data in response to lawful requests by public authorities to meet national security or law enforcement requirements.

11.Data access and corrections

If you wish to access, correct or delete your Personal Data, you may at all times do so free of cost by contacting Us as indicated below. Upon receipt from You of a written request and of information allowing Us to identify Your relevant Personal Data, this Personal Data as recorded or processed by Us will be either disclosed to you, deleted or corrected (and corrections will be notified to any third party recipients). You acknowledge however that requests to delete or correct Personal Data are subject to any applicable legal and ethical reporting or document retention obligations and that therefore, You should not expect that all of Your Personal Data will be completely removed from the databases in response to Your requests or corrected for the past.

13.Severance

If any provision of the Privacy Policy is deemed unlawful, void or for any reason unenforceable, than such provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provision. No waiver of any of the Privacy Policy shall be deemed a further of continuing waiver of such term or condition or any other term or condition.

14.General provisions

We reserve the right to modify the Privacy Policy at any time by posting the amended version on the Website with the indication of the date of the applicable version. You must check the Privacy Policy at every new visit and will be presumed to have read, to agree to and accept the modifications which will be applicable to You from Your first visit following the modification.
